These Terms and Conditions of Sale (the "T&Cs") govern all sales made by Athanix OÜ, operating the Plush Pages service (the "Seller"), via the plushpages.com website (the "Site"). The Seller's full identification is set out in the legal notice.
The Site offers a service for creating personalised comic books in which the child's cuddly toy (plush toy, fabric toy) becomes the hero of an illustrated adventure. The customer uploads one or more photos of the plush toy, chooses a storyline and personalises their book, which is then printed and delivered to their home.
Any order placed on the Site implies the customer's unreserved acceptance of these T&Cs (the "Customer").
Prices displayed on the Site are shown in euros (€). The Seller is not currently subject to VAT collection. Where taxes apply, they are computed automatically by our payment provider Stripe based on the billing location, and the corresponding amount is shown before payment.
Delivery is included in the displayed price. No separate delivery charge is added at payment: the amount paid corresponds to the price of the book and the chosen options, delivery included.
The Seller reserves the right to change its prices at any time. The applicable prices are those in effect when the Customer places the order.
The ordering process is as follows:
The order is considered final once full payment has been received. The Seller reserves the right to refuse any order on legitimate grounds (inappropriate content, suspected fraud, etc.).
Payment is made online securely via the Stripe platform. Accepted payment methods include bank cards (Visa, Mastercard, American Express), Apple Pay and Google Pay.
The total order amount is charged when the payment is confirmed. The Customer's banking data is never stored on the Seller's servers ; it is processed directly by Stripe in a secure environment compliant with the PCI-DSS standard.
Book printing and shipping are handled by our partner Gelato, a global print-on-demand network. Books are printed at the production centre closest to the delivery address to reduce delivery times and carbon footprint.
Estimated delivery times are 7 to 12 business days from order confirmation for deliveries in mainland France and the European Union. Deliveries are also available to certain non-EU countries ; delivery times may be longer.
The Seller cannot be held responsible for delivery delays caused by the carrier or by force majeure events. If a parcel is damaged or lost, the Customer is invited to contact customer service within 14 days of the estimated delivery date.
Under the Estonian Law of Obligations Act (võlaõigusseadus), which implements Directive 2011/83/EU on consumer rights, the Customer has in principle 14 days from receipt of the product to exercise the right of withdrawal.
However, the Estonian Law of Obligations Act, implementing article 16 of Directive 2011/83/EU, excludes the right of withdrawal for goods made to the consumer's specifications or clearly personalised. The right of withdrawal therefore cannot be exercised for these products.
As each Plush Pages book is custom-made from the Customer's photos and personalisation choices, it constitutes a personalised product within the meaning of this article. The Customer therefore expressly acknowledges that they do not benefit from the right of withdrawal for orders of personalised books.
This exclusion is clearly indicated to the Customer, who expressly accepts it by ticking a checkbox before confirming their order.
Cancellation window before printing: as long as the file has not been sent for printing, the Customer may request cancellation and a refund of their order. Once printing has started (file sent to our printer), the order can no longer be cancelled nor the print run stopped: a refund requested after this stage cannot halt printing already under way. The detailed terms are set out in our refund policy.
In the event of a lack of conformity or a hidden defect, the legal guarantees remain applicable (see Article 7).
All products sold on the Site carry the legal guarantee of conformity provided by the Estonian Law of Obligations Act (võlaõigusseadus), which implements Directive (EU) 2019/771. The Seller is liable for any lack of conformity existing at delivery and becoming apparent within two years of it.
In the event of a non-conforming product (printing error, missing pages, obvious quality defect), the Customer may request replacement or refund by contacting customer service within 30 days of receipt, enclosing photos of the observed defect.
The book illustrations are generated by artificial intelligence (AI) from photos provided by the Customer. The Customer retains a right of personal use over the book they created and ordered.
All elements of the Site (design, source code, texts, logos, trademarks, AI models, storylines, templates) remain the exclusive property of Plush Pages or its partners and are protected by Estonian, European and international intellectual property law.
Any unauthorised reproduction, representation or exploitation of all or part of the Site or its content is strictly prohibited.
The processing of Customers' personal data is governed by our Privacy Policy, accessible from the Site. The Seller undertakes to comply with the regulations in force applicable to the processing of personal data, in particular Regulation (EU) 2016/679 (GDPR).
The Seller undertakes to provide a service in accordance with these T&Cs. Its liability is limited to the amount of the order concerned.
The Seller cannot be held liable for indirect damage, data loss, or service interruptions resulting from the use of, or inability to use, the Site, nor for events of force majeure (natural disaster, strike, network failure, government decision, etc.).
AI-generated illustrations are artistic interpretations. The Seller does not guarantee a faithful reproduction of the photographed plush toy and cannot be held responsible for aesthetic differences between the generated result and the Customer's expectations.
These Terms are governed by Estonian law, the Seller being a company incorporated in Estonia. In the event of a dispute the parties will seek an amicable solution. Failing that, the courts of the Seller's registered office have jurisdiction, subject to any mandatory rule to the contrary: under Regulation (EU) 1215/2012 a Customer who is a consumer may bring proceedings in the courts of their own domicile and may be sued only there. Under Regulation (EC) 593/2008 (Rome I, article 6), this choice of law does not deprive a Customer who is a consumer of the mandatory protective provisions of the law of their country of habitual residence.
In accordance with Directive 2013/11/EU on alternative dispute resolution for consumer disputes and the Estonian Consumer Protection Act (tarbijakaitseseadus), the Customer may refer a dispute to the Consumer Disputes Board (Tarbijavaidluste komisjon), established at the Estonian Consumer Protection and Technical Regulatory Authority (Tarbijakaitse ja Tehnilise Järelevalve Amet): https://ttja.ee/tarbijavaidluste-komisjon, avaldus@komisjon.ee, Endla 10A, 10122 Tallinn.
